General Rental Conditions – Indian Ocean Holidays
ARTICLE 1
Rental vehicle made available to the renter for private use.
ARTICLE 2
The vehicle is intended exclusively for private use and for the transportation of passengers.
ARTICLE 3 – DRIVER CONDITIONS
The driver of the rented vehicle certifies that they hold a valid driving licence corresponding to the category of the rented vehicle and that they are not subject to any suspension, disqualification (driving ban) or cancellation of the right to drive in Mauritius.
The driver must be at least 21 years old and must have held a driving licence for at least 1 year (12 months).
“The vehicle may only be driven by the renter(s) declared in the contract, to the exclusion of any other driver.”
The renter remains fully responsible for the rented vehicle and its accessories.
ARTICLE 4 – TRANSFER OF THE RENTAL
The renter may neither transfer nor sublet the vehicle.
ARTICLE 5 – DURATION
This contract is concluded for the period indicated in the rental agreement (pickup and return dates).
ARTICLE 6 – RETURN
At the end of the contract, the renter must return the vehicle to the rental agency, to its premises, or to any other location indicated by the lessor.
The rental agreement and the renter’s responsibility end only when the lessor (or an authorized person) has effectively taken back possession of the vehicle.
The vehicle must be returned with its keys and all accessories/equipment provided at the start of the rental.
The vehicle and its accessories must be returned in the condition noted at the beginning of the rental. Loss or damage to the vehicle, keys, or accessories engages the financial responsibility of the renter.
ARTICLE 7 – RENTAL COST
The rental is concluded and accepted after full payment, in accordance with the rate indicated in the rental contract.
ARTICLE 8 – ADDITIONAL FEES
Any costs incurred by the lessor for recovering the vehicle are the responsibility of the renter, particularly if the vehicle is not returned to the agreed location.
The renter must bear all costs and repairs related to incorrect fuel usage.
ARTICLE 9 – MAINTENANCE AND REPAIRS
The renter undertakes to use the vehicle with care and to maintain it in good condition throughout the rental period.
The renter must keep the vehicle clean and must not carry out any modification or alteration.
The renter must carry out the usual checks required (including fluid levels and tyre pressure) and must inform the lessor of any anomaly.
Unless covered by insurance, the renter bears the cost of repairs resulting from damage, misuse, or negligence.
ARTICLE 10 – GENERAL CONDITIONS OF USE
Vehicle condition:
The renter takes possession of the vehicle in the condition in which it is made available.
In the absence of a joint inspection report signed by both parties, the vehicle is deemed to have been delivered in good condition and clean.
Use:
The renter must use the vehicle in accordance with the regulations in force and the Road Traffic Act in Mauritius.
Prohibited uses:
The renter may not use the vehicle:
– For motor competitions or as a driving school vehicle;
– To transport goods or passengers for payment;
– To tow or push another vehicle;
– With passenger overload or excess load;
– To transport flammable, explosive, toxic, or dangerous materials;
– To commit offences;
– Off-road (beach, sand, tracks, non-passable roads);
– Under the influence of alcohol, drugs, or substances affecting driving ability.
Insurance:
The vehicle is covered by insurance according to the guarantees provided in the rental contract. The applicable excess/deductible in case of damage is indicated in the rental contract.
Assistance:
Assistance is included in the event of breakdown or accident. The assistance number is indicated on the contract.
Damage:
In the event of an accident, theft, or damage, the renter must immediately inform the rental agency and notify the police when required.
The renter must complete an accident declaration/report and, where possible, establish an amicable accident report with the other driver.
If several vehicles are involved, a document must be completed with each driver. If the other party refuses to cooperate, the renter must record the registration number and, if possible, obtain witness statements and/or call the police.
The renter must provide the lessor with the police report number / police case number and transmit the requested documents without delay.
ARTICLE 11 – RESPONSIBILITY OF THE RENTER
The renter is responsible for any damage, loss, or theft occurring during the rental period, within the limits and conditions provided in the rental contract and by the insurance.
The lessor is not responsible for damage, loss, or costs suffered by the renter as a result of the use of the vehicle during the rental period, except in the event of fault by the lessor in accordance with applicable law.
ARTICLE 12 – TERMINATION CLAUSE
In the event of non-payment, payment failure, or breach of any clause of the contract, the lessor reserves the right to cancel the reservation and/or terminate the rental immediately, without compensation.
Any amount due under the contract remains payable.
ARTICLE 13 – SECURITY DEPOSIT
A security deposit of Rs 25,000 is required at the start of the rental. It may be paid in cash or by credit card pre-authorization, according to the conditions specified in the contract.
This deposit guarantees the fulfillment of the renter’s obligations.
Upon return of the vehicle, the deposit is refunded and/or the pre-authorization released after verification of the vehicle’s condition, less any amounts due (damage, missing fuel, fees, administrative charges). The release of the pre-authorization may take several working days depending on bank processing times.
Fines and penalties incurred during the rental period remain the responsibility of the renter. Administrative fees may apply if the lessor processes such offences.
In the event of a responsible accident, the applicable excess/deductible is the one indicated in the rental contract.
ARTICLE 14 – BILLING
Fuel: The vehicle is delivered with a fuel level indicated at departure and must be returned with an equivalent level. Otherwise, missing fuel will be charged and refueling fees may apply. No refund will be made if the vehicle is returned with a higher fuel level.
Offences: Fines, penalties, and parking charges are the responsibility of the renter. Administrative fees may apply if the lessor processes such offences.
Mileage: Mileage is unlimited unless otherwise stated in the rental contract.
ARTICLE 15 – RESERVATION AND CANCELLATION
Reservation: Any reservation is confirmed after full payment.
Modification: Modifications are possible without fees, subject to vehicle availability.
Cancellation: Free cancellation up to 7 working days before vehicle pickup. After this period, no refund will be issued. Working days are Monday to Friday, excluding public holidays in Mauritius.
Early return: No refund is due for unused rental days.
Extension: Any extension must be validated by the lessor, subject to availability. Additional days are charged at the initial rate stated in the contract.
• Only authorized drivers whose names appear on the rental agreement are covered by the insurance.
• In the event of driving under the influence of alcohol or drugs, the insurance does not apply and all costs (repairs, towing, fees) remain the responsibility of the renter.
• The vehicle must not carry more passengers than its capacity (number of seats).
The renter is responsible for using the appropriate fuel.
The vehicle is delivered with a fuel level indicated at pickup and must be returned with an equivalent level. Otherwise, the missing fuel will be charged and refuelling fees may apply.
Excess fuel will not be refunded.
• PAYMENT: The reservation is confirmed only after full online payment. No payment on site is accepted.
• REFUND / CANCELLATION POLICY: Free cancellation up to 7 working days before vehicle pickup (Monday to Friday, excluding public holidays in Mauritius). After this deadline, no refund will be issued. Once the rental has started, unused days (early return) are not refundable.
• VEHICLE CHANGE: A vehicle change (higher or lower category) may be authorized depending on availability and remains at the discretion of the agency. In case of a change of category or dates, the rate will be adjusted if necessary.
• EXTENSION: Any extension must be validated by the agency, subject to availability. Additional days are charged at the initial contract rate.
In the event of an accident, theft, fire, or damage, the renter must immediately inform Indian Ocean Tour Operator Co Ltd and notify the police when required. The vehicle must not be used after an accident without the prior authorization of the company.
When responsibility cannot be clearly established at the time of the incident, the company reserves the right to charge the applicable excess as indicated in the contract. After clarification of the case, an adjustment and/or refund may be made if necessary. Any costs related to processing this refund (bank fees, administrative fees, transfer fees, where applicable) remain the responsibility of the customer.
In the event of theft, loss, or damage to vehicle components (including spare wheel, jack and tools, antenna, windscreen wipers, mirrors, hubcaps, keys, or any equipment provided at the start), the renter will be charged replacement/repair costs up to the amount of the excess, unless otherwise specified in the contract.
Exclusions – Zero Excess option (SCDW)
The SCDW option does not cover, in particular: loss of keys, personal belongings left in the vehicle, damage resulting from improper handling (e.g. mirrors, car radio/multimedia equipment), as well as damaged tyres.
All our vehicles are delivered in good condition. During the rental period, in case of a mechanical problem or if a warning light/anomaly appears on the dashboard, the renter must stop as soon as it is safe to do so and immediately inform the company.
The renter is not allowed to modify, replace parts, or repair the vehicle without the prior authorization of the company. In the event of unauthorized intervention, the costs incurred remain the responsibility of the renter.
In the event of driving under the influence of alcohol or drugs, or dangerous driving / gross negligence, the insurance and guarantees do not apply and the renter remains responsible for all costs (damage, repairs, towing, fees).
